Protechnology reserves the right at any time to change or discontinue without notice, any aspect or feature of this website. No information contained on the website (whether posted by Protechnology or any of its partners, clients or suppliers) shall be construed as advice and same are offered for information purposes only.

Protechnology reserves the right to remove any material submitted or posted by you to the website and in the public areas, without notice to you, if it becomes aware and determines, in its sole and absolute discretion, that you are or there is the likelihood that you may:

Hacking of websites is common and while every attempt is made to prevent it, the complex nature of a site such as this makes hacking a reality. Should an unauthorised person post any message or material that is unlawful, harassing, defamatory, abusive, indecent, threatening, harmful, vulgar, obscene, sexually orientated, racially offensive, profane, pornographic or violates any applicable law, you hereby indemnify Protechnology against any loss, liability, damage or expense of whatever nature which Protechnology or any third party may suffer which is caused by or attributable to, whether directly or indirectly, your use of the website.

### 7. Merchant Selling, Pricing & Payment Methods (PayFast Compliance)
* **Accepted Payment Channels:** Protechnology accepts payments for standard hardware procurement, licensing setup, and managed IT services through the following secure billing methods:
1. **Secure Online Payment Gateway (PayFast):** Credit and Debit cards (MasterCard/Visa) along with supported Instant EFT options are routed securely through our integrated, PCI-DSS compliant partner **PayFast (Network One Services PTY Ltd)**.
2. **Direct Electronic Funds Transfer (EFT):** Traditional bank transfers can be processed straight into Protechnology’s designated corporate business bank account as outlined on our official invoices.
* **Cardholder Security:** For online gateway payments, Protechnology Group does not capture, harvest, or store raw credit/debit card numbers or bank authentication credentials on our servers. All sensitive banking data entry occurs directly within PayFast’s encrypted environment.
* **Currency Domicile:** All values, quotes, and online store pricing are presented exclusively in **South African Rand (ZAR)**.
* **Pricing Policy:** Standard product lines and recurring SLA configurations are displayed transparently including or excluding VAT as explicitly designated. Customized infrastructural project deployments, managed fiber setups, and high-density hardware procurement will be invoiced via formal legal quotation based on distinct client scopes.
* **Fulfillment:** Order fulfillment, hardware dispatch, and managed network or software activations will only proceed once confirmation of successful settlement funds is verified via the PayFast platform or once an EFT payment reflects clearly in our corporate bank account with an official Proof of Payment (POP) submitted.

### 8. Refund & Warranty Policy
In strict alignment with the South African Consumer Protection Act (CPA), No. 68 of 2008, Protechnology Group outlines the following terms concerning hardware equipment returns and warranties:
* **Manufacturer Warranties:** All networking equipment, smart switches, routing hardware, server parts, and surveillance or security components supplied by Protechnology are protected under their respective manufacturer-specific official warranties. Warranty periods and assessment parameters are bound by the terms of the original manufacturer or distributor.
* **Defective Hardware on Arrival (DOA):** Should hardware arrive structurally defective or experience early-stage failure, clients must notify us in writing within seven (7) days of delivery. Upon validation and technical confirmation of the fault, we will coordinate a product repair, component replacement, or process a gateway credit/refund.
* **Change of Mind / Returns:** For standard stock items returned unopened, completely unused, in their immaculate original packaging, and in verifiable resalable condition within seven (7) business days of invoice, a refund may be authorized. These returns are strictly subject to a fifteen percent (15%) handling and restocking fee. Return shipping logistics and associated delivery costs remain the total liability of the client.
* **Exclusions from Returns:** Customized computer builds, cut-to-length fiber-optic backbones, structured cabling installations, or software applications and user licensing that have been registered or activated cannot be returned for credit or refund.
* **Refund Settlement:** Approved financial refunds are finalized back through the original payment channel (PayFast gateway reversion or verified bank account EFT refund) within seven to ten (7-10) business days following technical product re-inspection at our depot.

### 9. Cancellation Policy
* **Hardware Order Dispatches:** Clients can request the cancellation of standard stock hardware orders at zero cost, provided the notification is formally received and acknowledged *before* physical consignment has been collected by couriers or released by our wholesale supply distribution hubs. Dispatched transit items are bound by our default Refund Policy protocols.
* **Service Agreements and Managed Services (SLA):** Cancellation of recurring month-to-month IT support agreements, managed cybersecurity protocols, cloud infrastructure operations, or backup data plans requires a fixed thirty (30) day written cancellation notice unless otherwise stipulated in a signed, bespoke Service Level Agreement contract.
* **Dedicated Project Inceptions:** Cancellation of structural network deployments, campus fiber rollouts, or surveillance network infrastructure integrations after a deposit payment has been cleared will result in the forfeiture of all raw costs already realized. This includes customized material allocations, equipment pre-procurement, and labor layout hours completed up to the specific physical date of cancellation.

### 11. Warranties, Disclaimers and Limitation of Liability
Protechnology makes no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the website and any of the information contained on the website. Accordingly, the website is made available and the information is provided to you on an “as is” basis.

Protechnology shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party, as a result of or which may be attributable, directly or indirectly, to your access and use of the website and any information contained on or accessed via the website and you hereby indemnify Protechnology in respect of any loss, liability, damage (whether direct or consequential) or expense of any nature whatsoever, which may be suffered by you and/or a third party as a result of or which may be attributable directly or indirectly to any of the aforesaid.

Notwithstanding anything to the contrary contained herein, Protechnology shall not be liable for any indirect, contingent or consequential loss (including but not limited to loss of business, loss of data and/or loss of profits) incurred or sustained by you or any third party howsoever arising in respect of your use of and/or reliance on any information offered on or via the website.

You further acknowledge and agree that your access to the website will not be free of interruptions, errors, technical inaccuracies, problems or other limitations, and that the website may be unavailable from time to time. You accordingly assume total responsibility and risk for your use of and reliance on the website and any information accessed via the website.

Protechnology shall be entitled from time to time, by giving notice to you, to vary its physical address for service to any other physical address within the Republic of South Africa.

### 13. General Agreements
These terms of use constitute the sole record of the agreement between you and Protechnology in relation to the subject matter hereof. Neither you nor Protechnology shall be bound by any express, tacit or implied representation, warranty, promise or the like not recorded herein. These terms of use supersede and replace all prior commitments, undertakings or representations, whether written or oral, between you and Protechnology in respect of the subject matter hereof. No addition to, variation or agreed cancellation of any provision of these terms of use shall be binding upon either you or Protechnology unless agreed to in writing by Protechnology.

No indulgence or extension of time which either you or Protechnology may grant to the other will constitute a waiver of or, whether by estoppel or otherwise, limit any of the existing or future rights of the grantor in terms hereof, save in the event or to the extent that the grantor has signed a written document expressly waiving or limiting such rights.

Protechnology shall be entitled to cede, assign and delegate all or any of its rights and obligations in terms of these terms of use to any third party.

All provisions of these terms of use are, notwithstanding the manner in which they have been grouped together or linked grammatically, severable from each other. Any provision of these terms of use which is or becomes unenforceable in any jurisdiction, whether due to voidness, invalidity, illegality, unlawfulness or for any reason whatever, shall, in such jurisdiction only and only to the extent that it is so unenforceable, be treated as *pro non scripto* and the remaining provisions of these terms of use shall remain in full force and effect.

Should Protechnology be prevented from fulfilling any of its obligations to you as a result of any event of force majeure, then those obligations shall be deemed to have been suspended to the extent that and for as long as Protechnology is so prevented from fulfilling them and your corresponding obligations shall be suspended to the corresponding extent.

In the event that force majeure continues for more than thirty days after it has first occurred, then Protechnology shall be entitled (but not obliged) to terminate all of its rights and obligations in terms of or arising out of these terms of use and/or any service by giving notice to you.

An **“event of force majeure”** shall mean any event or circumstance whatsoever which is not within the reasonable control of the affected party including, without limitation, *vis major*, *casus fortuitus*, any act of God, strike, theft, riots, explosion, insurrection or other similar disorder, war (whether declared or not) or military operations, the downtime of any telecommunications line, power failure, load shedding, international restrictions, any requirement of any international authority, any requirement of any government or other competent local authority, any court order, export control or shortage of transport facilities.

These terms of use shall be governed by and construed in accordance with the laws of the Republic of South Africa without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of the High Court of South Africa in respect of any disputes arising in connection with the services referred to herein, or these terms of use or any matter related to or in connection therewith.
